The Early Bird Rapist investigation had the Sheriff and Undersheriff Phillips (Sac Sheriff's Department) attention from what I can gather from memos and from sources (not Shelby) who were there in and around that time, they were convinced EAR and EBR were the same people. The information at that time (April 1976 approximately) was gathered by Sergeant Irwin according to a source I have and the Sheriff himself was using this information in this meeting. It was strange to have the Sheriff tell the investigators to combine EAR and EBR cases because he believed the two were one and the same. This coming from a Sheriff who not one time ever mentioning the East Area Rapist in any media coverage instead he had Bill Miller speak the words. My source (not Shelby) also stated once Sac PD publicly stated EBR and EAR are different offenders the position of the Sheriff's Department, at least to the public changed to reflect the same.
This type of event is a great example of the confusion and mismanagement that was occurring back then. Why was the Sheriff in the middle of this when his own people were telling him one thing and he chose another? I think Shelby wrote about this in his book but I am still confused about the whole EBR and EMR rapist investigations and can not figure it out. There is still one more offender maybe two and I even have a third suspect that a source says was responsible for some of the EBR attacks. The whole thing is a mess.
